The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 218 litres of mahua liquor was recovered and the petitioner who made an attempt to escape but was arrested.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner who has falsely been implicated in the case. The petitioner is in custody since 30.9.2020. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the

No.10055 of 2021(3) dt.30-09-2021 2/2 petitioner having remained in custody for one year, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 5725 of 2020 (arising out of Maner P.S. Case no. 540 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
