The petitioner seeks bail in anticipation of his arrest in connection with Banka P. S. Case No. 358 of 2020, instituted for the offences under Sections 147, 148, 323, 324, 207 and 504 of the Indian Penal Code. Several persons (16 in number) have been made
Patna High Court CR. MISC. No.10413 of 2021(2) dt.21-02-2022 2/3 accused in this case with the allegation of assaulting several of the victims including the mother of the informant. All other injured persons have received simple injuries except the mother of the informant who has received one grievous injury.
The petitioner along with others is said to have taken part in the assault.
However, there is no specific accusation against him.
Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P. S. Case No. 358 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
