JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hisua P.S. Case No. 93 of 2016 registered under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code. The accusation is that due to dispute of opening the door and putting the Chhaja, hot talks were exchanged. At that time, 6 persons named in the F.I.R. including the petitioners armed with lathi, danda and khanti reached there. On the order of Girja Singh, petitioner Dhananjay Singh gave rod blow on the head of the informant and Ranjit Singh caused injury through Khanti at the head of Subodh Singh. Thereafter, all the accused persons assaulted the informant and his brother.

No.34116 of 2016 (2) dt.31-08-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that the petitioners and other accused are agnate of the informant and due to land dispute, occurrence took place, regarding which Hisua P.S. Case No. 94 of 2016 is also instituted on the written report of Heena Devi, wife of co-accused Girija Singh. Moreover, injuries, as found on the person of the informant and his brother, are simple in nature caused by hard and blunt substances.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Nawada in connection with Hisua P.S. Case No. 93 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
