2. The petitioners are named in the F.I.R. and apprehending their arrest in connection with Warisaliganj P.S. Case No. 544 of 2024 registered for the offences punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 61(2), 3(5) of BNS and Section 66(B), 66(D) of IT Act.

3. As per FIR, petitioner alongwith other apprehended co-accused persons were involved in cyber fraud and to cheat the innocent people. It is further alleged that upon search mobile message, scanner of customers, PDF of M/s Dhani Finance and Bajaj Finance approval letters were

It is submitted by learned counsel appearing on behalf of the petitioners that the name of both petitioner appears in this case on the basis of disclosure made by apprehended co-accused namely, Ankit Kumar and Vikash kumar, in furtherance of which no incriminating material recovered from this petitioner. It is submitted that even the seized items failed to connect petitioner with crime in question. It is also pointed out that as far investigation of this case is concerned same appears concluded on all material points qua co-accused Ankit Kumar and Vikash kumar and therefore, custodial interrogation of these petitioner is not required and thus by sending this petitioner to jail would not serve any purpose of justice. While concluding arguments, it is submitted that both above named petitioners are men of clean antecedents.

5 Learned APP opposes the prayer of bail.

6. In view of aforesaid factual submission and by taking note of fact as save and except suspicion out of

No.54240 of 2025(3) dt.12-11-2025 3/3 disclosure made by apprehended co-accused persons primafacie nothing incriminating material appears against petitioner, accordingly both above-named petitioner, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Nawada/concerned Court, where the case is pending in connection with Warisaliganj P.S. Case No. 544 of 2024, subject to the conditions as laid down under Section 482(2) of BNSS.
