The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 409 and 120(B) of the Indian Penal Code.

It is a case of irregularity committed in distribution of Pradhan Mantri Aawas Yojna (Gramin) by the accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that after it came to the knowledge that ineligible beneficiaries have received payment, the amount was recovered and got it deposited in the official bank account of the scheme which is annexed as Annexure-2 to the petition.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Motihari Muffasil P.S. Case No. 411 of 2021 (G.R. No.2495 of 2021), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
