2. The petitioner apprehends his arrest in connection with Brahampur (Nainijor) P.S. Case No. 31 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. As per prosecution, the recovery is of 231 litres of illicit liquor. One Aaush Kumar who is caught from the spot has taken the name of the petitioner. The petitioner is also accused in one similar case.

4. Learned counsel for the petitioner submit that petitioner has falsely been implicated in this case. Petitioner has one criminal antecedent of similar nature in which he is on bail.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this is not a fit case for grant of anticipatory bail, this application for anticipatory bail is dismissed. The petitioner is directed to surrender within four weeks.
