2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411, 414 & 120B of the Indian Penal Code and Section 192 and 194 of the M.V. Act.

3. The tractor of the petitioner is said to have been seized by the police laden with 80 CFT sand without any valid chalan.

4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Learned counsel for the petitioner further submitted that petitioner is ready to deposit the loss

Patna High Court CR. MISC. No.57966 of 2024(2) dt.03-12-2024 2/3 amount in lieu of 80 CFT sand. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposed the prayer for bail.

6. Having regard to the facts and circumstances of the case and the fact that petitioner is ready to deposit the loss amount, let the above named petitioner, be released provisionally for a period of one month, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sandesh P.S. Case No. 99 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

7. The petitioner is directed to approach before the concerned department/authority for assessment of loss amount and deposit it as per the direction of the authority.

8. The learned Court below is directed to confirm the bail bond of the petitioner after satisfying that the petitioner has deposited the loss amount assessed by the concerned
