JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Pirbahore P.S. Case No. 220/2021 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation, as per the First Information Report, is that three persons were intercepted by the Police and from possession of FIR named accused Raushan Kumar Ojha, one loaded pistol was recovered along with realme Mobile Phone and from two persons Mobile phones were recovered. The arrested co-accused persons disclosed that the firearm was given to them by the co-accused Dablu Chai who is dreaded criminal. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.63697 of 2021(2) dt.23-05-2022 2/2 petitioner has falsely been implicated in this case and no firearm etc. has been recovered from possession of the petitioner. One Mobile phone of Jio company has been recovered from the possession of the petitioner. The petitioner is in custody since 8.7.2021 and charge sheet has already been submitted. Coaccused Raushan Kumar Ojha has been granted bail by this Court in Cr. Misc. No. 48213 of 2021. The case is triable by the Magistrate.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioner is in custody since 8.7.2021, Co-accused has been granted bail and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Patna, in connection with Pirbahore P.S. Case No. 220 of 2021.
