JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This is an application for grant of anticipatory bail in connection with Parsa P.S. Case No. 48 of 2018, disclosing offences under Sections 498(A), 494 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be the husband of the informant, is of cruelty and harassment for demand of dowry and also allegation of remarried with another girl.
Submission of learned counsel for the petitioner is that the informant was mentally sick and as such he was married with another girl. Further, he is ready to keep the informant with all dignity and care.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.78451 of 2018(3) dt.09-01-2019 2/2 Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
