JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, all the FIR named accused persons entered into house of the informant and made indiscriminate firing upon the informant's brother, Satyendra Dubey and Pankaj Thakur and also on the informant's son, Kishan Dubey, as a result of which Satendra Dubey and Kishan Dubey died. One person from the accused side was also died on the spot.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.63719 of 2021(3) dt.11-04-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. Petitioner is not named in the FIR and his name subsequently sprang up during the course of investigation and only material that has come against this petitioner is that he is business partner of one of the co-accused. Petitioner claims clean antecedent and is in custody since 10.08.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Muzaffarpur in connection with Kaji Mohammadpur PS case No. 214/2006.
