Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Delha P.S. Case No. 121 of 2020 registered for offence punishable under sections 452, 504, 506, 354 (D) & 354(B)/34 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that prior to this case, Delha P.S. Case No. 96 of 2020 has been lodged by the father of the informant alleging therein that the present petitioner has kidnapped the informant. In that case, the

No.10373 of 2021(4) dt.21-02-2022 2/3 statement of the informant was recorded and in her statement recorded under Section 164 of the Cr.P.C., she has stated that nobody had kidnapped her and she has left her house with her own sweet will and she has also stated that she married with the present petitioner. All these facts have been mentioned in the order of learned Additional Sessions Judge-III, Gaya and it has also been mentioned therein that the petitioner was granted bail in Delha P.S. Case No. 96 of 2020.
Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Gaya in connection with Delha P.S. Case No. 121 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that if the Court below finds that the petitioner is tampering with the evidence in trial, the Court below shall be at liberty to pass an appropriate order in accordance with law. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this
