Patna High Court CWJC No.9931 of 2017 dt.01-08-2017 2/2 respondent Nos.7 to 21 and no action is being taken for removal of the encroachment in spite of the fact that the Circle Officer, Manjhi, District Saran, respondent No.6, has been apprised of the situation and except for calling for reports, he has not taken any concrete action for removal of the encroachment, this petition has been filed in public interest.

Taking note of the grievance of the petitioner and considering the fact that respondent No.6 is a statutory authority empowered under law namely Bihar Public Land Encroachment Act to remove the encroachment, we direct respondent No.6 to take cognizance of the grievance of the petitioner and initiate the process for removal of encroachment alleged in accordance with law and decide the question of encroachment after hearing all concerned, preferably within six months and ensure that encroachment, if any found, be removed.
