The petitioner apprehends his arrest in connection with Masaurhi P.S. Case No. 128 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of the seizure list, it appears that the alleged recovery of illicit liquor has been made from the toilet of Bhagwan Yadav. Petitioner has no concern with the recovered illicit liquor.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

No.63387 of 2021(2) dt.25-04-2022 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cumSpecial Judge, Excise Act, Patna in connection with Masaurhi subject to the condition as laid down under Section 438(2) of the Cr. P.C.
