Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Khushrupur P.S. Case no. 191/2018 registered for the offence punishable under section 304B/34 of the Indian Penal Code. Accusation against the petitioner who happens to be husband of the deceased is that he killed the deceased due to dowry.
It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case and marriage took place six years ago and they were living happily.It is further submitted that petitioner had never demanded any dowry and there is no specific allegation against this petitioner. In fact, deceased
Patna High Court CR. MISC. No.9746 of 2021(3) dt.19-07-2021 2/2 committed suicide. Petitioner is in custody since 17.08.2020. However, learned counsel for the State opposed the prayer for bail.
Considering the rival submissions and materials on record that this petitioner being husband of the deceased and deceased died within seven years of marriage under suspicious circumstances, this bail application is rejected. (Prabhat Kumar Singh, J) s.hassan/- U T
