Petitioner apprehends arrest in connection with Nalanda Mahila P.S. Case No. 52 of 2016 registered under Sections- 354B, 504 of the Indian Penal Code. It is alleged that when the informant was sleeping with her child, the petitioner alongwith another accused entered into her house and started molesting her. On raising protest this petitioner put his pistol on her chest and threatened to kill her and started tearing her clothes. On the cry made by her child, people of nearby assembled then the accused persons fled away. Learned counsel for the petitioner submits that petitioner is the uncle of the other accused namely Laltun
Patna High Court Cr.Misc. No.31969 of 2016 (5) dt.09-02-2017 2/2 Yadav and it is impossible that he alongwith his nephew entered the house of the informant. F.I.R. has been lodged after delay of three days without any explanation.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused and there is direct allegation against him.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
