The petitioner being the Headmaster of the school is apprehending his arrest in a case registered for the offences punishable under Sections 457, 38, 411/34 of the Indian Penal Code.
The prosecution case is that the cook of the Primary Government School, Basudeo Chapra namely Pawan Pandey was stealthily removing rice bags from the school premises, who was caught by the villagers. He confessed that on the instruction of petitioner he was removing rice from the school.
It is submitted by the learned counsel for the petitioner that the cook was found stealing the rice and nothing
Patna High Court Cr.Misc. No.41843 of 2015 (2) dt.12-10-2015 has been brought on record that the cook was instructed by the petitioner.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 28 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
