The petitioner apprehends his arrest in Chapra Town P.S. Case No. 326/2012, registered for the offences punishable under Sections 364, 365 of the Indian Penal Code. The mother of the victim named the petitioner along with other accused persons and alleged that they kidnapped her daughter. The victim was recovered and she also disclosed the name of the petitioner and other accused persons. The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 08.10.2015, but the victim filed a petition before the court below stating that she wrongly named the petitioner. On this ground alone, the petitioner filed the petition for anticipatory bail. I do not find any sufficient ground to review my own
Patna High Court Cr.Misc. No.30326 of 2016 (2) dt.26-11-2016 2/2 order dated 08.10.2015 passed in Cr. Misc. No. 44246/2016 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders before the court below within four weeks from the date of receipt/production of a copy of this order and prays for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order. (Prabhat Kumar Jha, J.) Rakhi U T
