JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 Petitioners apprehend their arrest in connection with Thawe P.S.Case No. 123 of 2018 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code. Allegation against the accused persons, including the petitioners is of kidnapping of minor daughter of the informant. Submission of learned counsel for the petitioners is that as a matter of fact the victim has love affair with son of petitioner No.1 and she married with the son of petitioner No.1, which will appear from the statement of the girl recorded under Section 164 Cr.P.C. and the girl has already been released in favour of son of petitioner No.1 and petitioner Nos. 2 and 3 are brothers.

No.77939 of 2018(2) dt.04-01-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S.Case No. 123 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in investigation, otherwise their bail bonds shall be cancelled.
