The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304(B), 201, 341, 323, 504 and 34 of the Indian Penal Code. Pramod Singh and Biresh Singh, petitioners are elder brother of the husband of victim Guriya Devi. Guriya Devi died in her matrimonial house in unnatural circumstances within seven years of her marriage and there is allegation of demand of dowry and torture for the same.
The case diary would reveal that some other witnesses have also supported the allegation of demand of dowry and torture for the same soon before the death of Guriya Devi. Learned counsel for the petitioners submits that in
Patna High Court Cr.Misc. No.35634 of 2016 (3) dt.02-02-2017 2/2 para 43 witness Ram Ayodhya Mahto has stated before the police that the petitioners were separate from their brother and due to family quarrel Guriya Devi committed suicide. Considering the materials against the petitioners, in my view, they do not deserve anticipatory bail. Hence, their prayer for bail is refused in connection with Barauli Police Station Case No. 64 of 2016 pending in the court of learned Chief Judicial Magistrate, Gopalanj.
