The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
It is a case of snatching of motorcycle of the informant by the accused persons.
It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. The name of the petitioner sprang up on the confessional statement of the co-accused Gulshan Kumar who was arrested in some other case. The stolen motorcycle has
Patna High Court CR. MISC. No.63477 of 2021(3) dt.06-07-2022 2/2 neither been recovered from the possession of coaccused Gulshan Kumar nor from the possession of the petitioner. The petitioner was not apprehended from the spot and since Gulshan Kumar was on inimical term with the petitioner from before, hence, he named the petitioner.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 85 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
