KUMAR ) 27-09-2022 This modification application has been listed under the heading "To Be Mentioned" at the instance of the learned counsel for the petitioner, seeking modification of the judgment dated 05.08.2022 passed in CWJC No. 11095 of 2022. Learned counsel for the petitioner submits that in view of the judgment dated 05.08.2022 passed in CWJC No. 11095 of 2022, petitioner approached Collector, for release of her vehicle but District Magistrate cum Confiscation Officer, Gopalganj, demanded bank guarantee of Rs. 25.65 Lacs in view of the depreciated value as mentioned in earlier policy. He further submits that as the policy was about to expire, petitioner renewed the insurance policy and in that policy the depreciated

Patna High Court MJC No.1820 of 2022(2) dt.27-09-2022 2/2 value of the vehicle has been mentioned as Rs. 10 Lacs and petitioner is ready to furnish bank guarantee of Rs. 5 Lacs but the District Magistrate cum Confiscation Officer, Gopalganj, is not accepting the bank guarantee of Rs. 5 Lacs. In view of the submission made above, petitioner is directed to furnish total Rs. 10 Lacs as bank guarantee to get her vehicle released in terms of judgment dated 05.08.2022 passed in CWJC No. 11095 of 2022.

The judgment dated 05.08.2022 passed in CWJC No. 11095 of 2022 is modified to the extent indicated above. (Sanjay Karol, CJ) ( S. Kumar, J) ranjan/- U
