2. In the present case, the petitioner seeks bail in connection with Harpur P.S. Case No. 64 of 2025 registered for the offences under Sections 137(2), 96 of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 & 12 the POCSO Act.
3. The allegation in the first information report is that the informant and his wife went out their house and then the petitioner kidnapped his minor daughter namely Rani Kumari for the purpose of marriage.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case of kidnapping and he has pointed out the victim after recovery has

No.53173 of 2025(3) dt.28-11-2025 2/2 given her statement u/s 180 and 183 B.N.S.S. and the perusal would indicate that on account of some ill treatment by her family members she has herself called the petitioner and left with him voluntarily by her own will and also got married with him. The petitioner has no criminal antecedent. He is a young boy of 21 years of age and is in custody since 20.05.2025.
5. Learned A.P.P. appearing for the State and learned counsel for the informant opposes the grant of bail.

In view of the statement of the victim made under Section 180 and 183 of the B.N.S.S showing her will to go along with the petitioner and even performing marriage with him coupled with the fact that the petitioner is a young boy with no criminal antecedent and charge-sheet has also been submitted, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned 7th District and Additional Sessions Judge, POCSO Act, East Champaran, Motihari, Bihar in connection with Harpur P.S.
