The petitioner apprehends his arrest in Darbhanga Mahila P.S. Case No. 15 of 2016 registered for the offences punishable under Section 354A and other Sections of the Indian Penal Code.

The victim made specific allegation that the petitioner entered into her house with an intention to outrage her modesty at 10:00 p.m. in the night and tried to strip off her clothes. The petitioner torn her undergarments, but on alarm many persons came there and the petitioner managed to flee away. It is submitted that the case is lodged after two weeks of the occurrence and there is no explanation, but it appears that the informant gave a petition before the officer - in - charge ,

Patna High Court Cr.Misc. No.27939 of 2016 (3) dt.30-09-2016 2/2 Kamtaul police station who did not take any action thereafter, the informant gave a petition to the S.S.P., Darbhanga who directed to register the case and at the same time asked for show cause from the SHO, Kamtaul. The petitioner has also got criminal antecedent and he is accused in one case of similar nature. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
