Petitioner seeks bail in a case registered for the offences punishable under Sections 376(G) of the IPC and 4/6 POCSO Act.
The case is at the stage of final argument.
In the past, prayer for bail was refused as the petitioner was carrying allegation under Section 376(G) IPC as well as 4/6 of the POCSO Act.
Considering the stage of trial, I am not inclined to enlarge the petitioner on bail in connection with Sitamarhi Mahila P.S.Case No.02 of 2017, Trial No.24 of 2017 pending in the court of learned Additional Sessions Judge-VI-cum-Special Judge (POCSO Act), Sitamarhi. Hence, prayer is refused. The learned Trial Court is directed to expedite the
Patna High Court CR. MISC. No.10161 of 2021(3) dt.13-08-2021 2/2 hearing of the case even through virtual mode and if the parties would not be cooperative in early disposal of the case, the learned Trial Court would submit a special report after six months.
