Heard the parties.
This application, for grant of anticipatory bail, arises out of Dihri Dalmianagar P.S. Case No. 197 of 2016 (G.R. No. 368/2016), disclosing offences under Sections 147, 149, 341, 323, 307, 353, 506 and 379 of the Indian
Patna High Court Cr.Misc. No.37238 of 2016 (3) dt.23-09-2016 2/3 Penal Code and Section 135 of the Electricity Act. The petitioner, who is personally present, has submitted that an amount of Rs. 63,619/- shall be deposited by him in the appropriate account, which, according to the First Information Report, is the loss caused to the South Bihar Power Distribution Company Ltd. because of theft of electricity, which was allegedly being committed by the petitioner.
It is also alleged in the First Information Report that the accused persons had misbehaved with and assaulted the team of the company, which had gone there for the purpose of conducting raids.
Learned counsel for the petitioner has submitted that though there might have been some altercation between the members of the team and the accused persons, the allegation, which has been made in the First Information Report, is an exaggerated version. Considering the facts and circumstances of the case and the stand taken by the petitioner, as noted above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.37238 of 2016 (3) dt.23-09-2016 3/3 satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram, in connection with Dehri Dalmianagar P.S. Case No. 197 of 2016 (G.R. No. 368/2016), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
