2. The petitioner seeks bail in a case registered for the offence under Section 377/34 of the Indian Penal Code, Section 04 of the POCSO Act, 2012 and Section 3(2)(V) of SC/ST Act.
3. As per F.I.R. petitioner and other accused persons allegedly committed unnatural sexual assault with the minor victim boy.
4. Learned counsel for the petitioner submits that the victim in his statement recorded under Section 164 Cr.P.C. has not alleged any wrong against the petitioner. Petitioner has got clean antecedent and is in custody since
Patna High Court CR. MISC. No.52711 of 2025(3) dt.01-12-2025 2/2 01.07.2025. Charge-sheet has been submitted.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the statement of the victim recorded under Section 164 Cr.P.C. and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VI-cum-Special Judge, POCSO, Gopalganj in connection with POCSO Case No. 32 of 2022, arising out of Phulwariya P.S. Case No. 220 of 2021.
