JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Halsi P.S. Case No. 34 of 2015 for the offences instituted under Sections 341, 323, 448, 324, 504, 147, 148, 149 and 307 of the IPC. Later on, Section 302 IPC has also been added. The prosecution story, in brief, is that the husband of the informant, namely, Rebu Bind, was taking breakfast on his door, in the meantime, about 10-12 people was coming from Mohiyan Village on the occasion of Holi-Hurdang. All the FIR named accused persons belonged to Mohiyan Village having lathi and Khanta in their hands, were throwing the mud on the informant

Patna High Court Cr.Misc. No.27361 of 2016 (2) dt.12-07-2016 2/3 and her husband. In the meantime, co-accused Harikant Paswan hit on the head of the informant's husband by a Khanta, Rakesh paswan also assaulted from lathi and the other co-accused persons also assaulted on the body thereupon blood started oozing. Thereafter, the victim became senseless. After that the police party came and sent the victim to Lakhisarai Hospital for treatment but there the doctor immediately referred to Patna for better treatment. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The specific allegation is against Hari Kant Paswan and Rakesh Paswan. Hari Kant Paswan has already been granted anticipatory bail vide Cr. Misc. No. 7560 of 2016 by another co-ordinate Bench. No specific injury has been attributed against the petitioner. General and omnibus allegation has been made against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Halsi P.S. Case No. 34/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the
