JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 This is an application for grant of anticipatory bail in connection with Shivsagar P.S. Case No. 120 of 2019, disclosing offences under Sections 147, 149, 341, 332, 337, 353 of IPC and Section 9 of Bihar Control Use and Play of Loudspeaker Act.

Prosecution case is that police got information that on the eve of Holi, some persons are playing loudspeaker in the late night and for that there is a scuffle between the parties and when the police party reached there to pacify the matter, whereupon the people started pelting stones upon the police party, out of which petitioners were also assaulted by the police party.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub JudgeVII, Sasaram, Rohtas, in connection with Shivsagar P.S.
