1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in S.T. No.16 of 2022 arising out of Barauni P. S. Case No.323 of 2020 registered for the offences punishable under Sections 341, 323, 447, 324, 307, 302, 120B/ 34 of the Indian Penal Code.

3. This is the third attempt of the petitioner to seek bail. Earlier, the petitioner has moved seeking bail vide Cr. Misc. No.35398 of 2021, which was rejected by order dated 10.02.2022. Thereafter, again the petitioner had moved seeking bail vide Cr. Misc. No.52784 of 2022, but the same was also rejected by order dated 12.10.2022.

4. It is next submitted that petitioner is alleged to have assaulted the deceased. It is next submitted that presently four

Patna High Court CR. MISC. No.53738 of 2023(2) dt.16-08-2023 2/2 prosecution witnesses have been examined, but now, the Court is vacant, as such, it is not possible to conclude the trial expeditiously. It is on these grounds that the petitioner has renewed his prayer for bail.

5. The learned Additional P. P. opposes the bail application of the petitioner.

6. The Court, for the present, is not inclined to release the petitioner on bail.

7. Accordingly, the prayer for bail stands rejected.

8. However, the learned trial Court is directed to expedite the trial and to ensure that the trial is completed within a period of nine months from the date of receipt/production of a copy of this order, if possible. Since it has been submitted by the learned counsel for the petitioner that presently, the Court is vacant, as such, let a copy of this order be sent to the learned District and Sessions Judge, Begusarai for his perusal and necessary action.
