The petitioner seeks bail in Bettiah Town P.S. Case No. 130 of 2019, instituted for the offence under Section(s) 30(a) and 56 of Bihar Prohibition and Excise Act. As per written report five persons were apprehended by the Police on the information that they are bringing foreign liquor in a tourist bus. The bus was searched and 941.400 litres of foreign liquor has been recovered from hidden cabin made below the floor of the bus. The apprehended persons disclosed the name of petitioner.

Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner.

Patna High Court CR. MISC. No.49914 of 2019(2) dt.21-08-2019 2/2 He further submits that other co-accused have already been granted bail by coordinate Bench of this Court vide order dated 14.5.2019 passed in Cr. Misc. 32001 of 2019.

Petitioner is in custody since 28.5.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No. 130 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.

It is mentioned in paragraph-3 of the bail petition that three excise cases are pending against the petitioner. Petitioner will file affidavit at the time of furnishing bail bonds that he will not indulge in such type of activity in future, failing which, the bail bonds of the petitioner in the instant case will liable to be cancelled.
