=========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 25-04-2016 It has been submitted that the Petitioner no. 1 has died and therefore, his application become infructuous. It is dismissed as such.
The petitioner seeks quashing of the order of none diascharge dated 4.10.2010 passed in G.R. No. 3103 of 2002 arising out of Gandhi Maidan P.S. Case No. 237 of 2002.
It is submitted that the petitioner is sought to be put on trial on allegation of his affiliation with Ranbir Sena which has not yet been declared a band organization and hence his charge would be nonest. Considering that even if no offence under the Criminal Law (Amendment) Act and The Unlawful Activities (Prevention) Act is made out I find there are other offences also for which the petitioner is sought to be tried, I find no merit in the application. Hence the same is dismissed.

No.43434 of 2010 dt.25-04-2016 The trial Court is directed to conclude the trial positively, within 8 months from the date of receipt of a copy of this order looking into the seriousness of the offence without granting any unnecessary adjournment to any parties. The Trial Court is directed to send a list of remaining witnesses/ the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police concerned and the concerned Superintendent of police is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
