The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272, 273,420 of the Indian Penal Code and Sections 47a, 47g, 49, 50d, 51 and 59a of the Bihar Excise (Amendment) Act 2016. Learned counsel for the petitioner submits that alleged recoveries were not made from his conscious possession. Rather, they were recovered from a bamboo-clump and were hidden in a bag.

Considering the nature of allegations made and the said amount of liquor has not been recovered from the petitioner's personal possession, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of

No.32796 of 2016 (2) dt.02-09-2016 P2/2 receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Yadopur P.S. Case No. 36/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
