The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 32 3, 326, 333, 337, 307, 353 and 153A of the Indian Penal Code.

The prosecution case is that co-accused Mantu Kumar, Satkar Chaurasia, Ramjee Sharma, Vijay Kumar and their associates protested the measurement of land in question of one late Bipata Mian. During the measurement the protest was made by raising slogan against the Muslim community when the stones were pelted.It is specifically alleged that co-accused Satkar Chaurasia assaulted on the head of A.S.P.

Patna High Court Cr.Misc. No.43623 of 2015 (2) dt.14-10-2015 2/2 and some constable as a result they received injury. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. The name of the petitioner subsequently sprang up.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation against the mob, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 262 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
