The petitioner apprehends his arrest in connection with Kakamkuan P.S. Case No. 132 of 2019, registered under Sections 341, 307, 379 and 323/34 of the Indian Penal Code. Accusation is that in the evening of 25.02.2019, when informant Naresh Kumar reached at his house then saw his wife in objectionable condition with Saurav Kumar @ Sani (Petitioner), when informant opposed then his wife Moni Devi, mother in law Shanti Devi and Saurav Kumar with intention to kill assaulted him through iron rod in which he sustained injury. On raising alarm, Narendra Kumar @ Arun Singh and Ajay Kumar, uncles of informant, came there and saved the

Patna High Court CR. MISC. No.57117 of 2019(3) dt.19-09-2019 2/2 informant. At that time, wife of the informant moved along with children taking mobile and cash of Rs. 21,000/-. Learned counsel appearing on behalf of the petitioner submits that informant, in drunken state, started assaulting his wife and petitioner intervened in the matter due to that reason, the informant lodged the present case with false allegation. Further submission is that, since, petitioner and wife of informant used to do job in same company and informant implicated the petitioner mere on suspicion. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-VIIcum-A.C.J.M., Patna in connection with Kadamkuan P.S. Case No. 132 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
