Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Co-accused-Sajjan Kumar is assailant of the deceased by causing injury with a sharp cutting weapon. Petitioner is one of the members of the unlawful assembly. Petitioner is in custody since 11.08.2020. Investigation of the case is already complete.

Since no overt-act is alleged against the petitioner and investigation is complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty

Patna High Court CR. MISC. No.10259 of 2021(2) dt.30-06-2021 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Darbhanga Town Police Station Case No.222 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
