In this case, the petitioner is apprehending his arrest in connection with Aurangabad (Town) P.S. Case No. 220 of 2011 for offence under Sections 420, 467, 468, 406, 120(B) of the Indian Penal Code.

As per allegation, the petitioner and others came to the house of the Informant and directed him to deposit the installment of his premium and, as such, the Informant went to the office and gave Rs. 45,000/- to the accused no.11, Arun Sharma who handed over the same to the accused no.2, Rakesh Kumar. Later on again Rs. 45,000/- was given as second installment. Thereafter, it

Patna High Court Cr.Misc. No.26829 of 2016 (2) dt.04-07-2016 transpired that the second installment of Rs. 45,000/- was not deposited as a premium.

Learned counsel for the petitioner submits that this incident is of the year 2008. During that period, he was there and later on he left the organization and joined MBA to enhance the educational qualification. Learned counsel for the petitioner further submits that the specific allegation is against accused nos. 2 and 11 and, in no way, the petitioner has been shown to be involved in the matter of misappropriation of the said amount. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Barun Kumar Singh @ Varun Kumar Singh in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Aurangabad (Town) P.S. Case No. 220 of 2011 (G.R. No. 1445 of 2011), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
