JUSTICE RAVI RANJAN ORAL ORDER 26-02-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 379, 448 and 504 of the Indian Penal Code.

It is contended that though there is allegation against the petitioner of assaulting upon the head of the informant but it would appear from the order of the Sessions Judge, Patna that the doctor has found only simple laceration upon his head. It is further contended that there is a case and counter case between the parties. It is also contended that the allegation of theft is merely ornamental.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Murari Yadav be released on

Patna High Court Cr.Misc. No.42533 of 2015 (3) dt.26-02-2016 2/2 bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Paliganj P.S. Case No.90/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Danapur, Patna subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
