JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-02-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Bahera P.S. Case No. 47 of 2020 registered for offence punishable under sections 406, 420/34 of the Indian Penal Code. The learned counsel for the petitioners has submitted that the main culprit is Pankaj Kumar Jha, who is Mukhiya and due to his pressure, money was transferred in his account and in this respect, the present petitioners have made complaint against the

Patna High Court CR. MISC. No.9918 of 2021(4) dt.21-02-2022 2/2 the Mukhiya. The letters of that complaint have been annexed as Annexures-2, 3 and 4. He has also submitted that the Mukhiya, against whom the main allegation was levelled, has been granted regular bail by a coordinate Bench in Cr. Misc. No.12258 of 2021, vide order dated 29.06.2021, on the ground that he was ready to deposit the amount of Rs.2,75,000/- and that amount has already been deposited.

Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur Sub-divisional Court, Darbhanga in connection with Bahera P.S. Case No. 47 of 2020, subject to condition as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
