JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506, 34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The accusation is of outraging the modesty of the informant, making assault and abusing by calling cast name. It is also alleged that accused persons snatched gold chain of the informant.
It is submitted by learned counsel for the petitioners that for the occurrence of 8/3/2015 the F.I.R was registered on 9/3/2015. The accusation has been levelled in the background of petty dispute. Moreover the informant has subsequently retracted from the initial version and has filled a petition to that effect before learned court below.
Patna High Court Cr.Misc. No.41999 of 2015 (2) dt.13-10-2015 2/2 A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Digha P.S. Case No. 72 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
