JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 12-02-2018 From the facts that have come on record we find that this Public Interest Litigation has been filed seeking quashing of a mining lease license granted to the respondent no. 9 and for making an impartial investigation and enquiry into the illegal sand mining in the district of Kishanganj.
As far as grant of mining lease to the respondent no. 9
Patna High Court CWJC No.8902 of 2017 (10) dt.12-02-2018 2/2 is concerned, the same has already been cancelled vide order passed on 16.12.2017 and the respondent no. 9 has already challenged the same in Writ Petition bearing CWJC No. 283/2018 which is pending before an appropriate bench for consideration. In view of the above, challenge to the mining lease granted to the respondent no. 9 in this Public Interest Litigation now stands rendered infructuous in view of these developments. As far as illegal mining activities in the district and other allegations are concerned, we direct the petitioner to submit a detail representation in this regard to the Principal Secretarycum-Mines Commissioner in the department concerned, who shall look into the same and decide the matter.
