====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 11-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

02. In the present case, the petitioner is apprehending his arrest in connection with Lakhisarai P.S. Case No. 207 of 2024 registered for the alleged offences under Section 341, 323, 308, 504, 506 and 34 of the Indian Penal Code.

03. As per prosecution case, the petitioner assaulted the informant with a brick causing bleeding. The other co-accused persons also assaulted her.

04. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and has been falsely implicated in this case. The informant is own sister-in-law of the petitioner who has made allegation against the petitioner and other co-accused persons who are her mother-in-law and elder brother-

The petitioner did not assault the informant and it has come in the FIR that petitioner and his mother have put the informant on ground and in this occurrence she might have received injuries. Learned counsel further submits that in the background of land dispute the informant has always been quarreling with her in-laws and the allegation that petitioner came in drunken condition is false and concocted. Learned counsel further submits that even the injury of the informant is stated to be simple as it is an injury on forehead of size 1" x 1/4"x bonedeep.

05. Learned A.P.P. for the State opposes the submission made on behalf of the learned counsel for the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the relationship of the parties and the background of land dispute and further considering simple nature of injuries alleged against the petitioner, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of Court of learned C.J.M., Lakhisarai in connection with Lakhisarai P.S. Case No. 207 of 2024, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and other following

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
