Petitioner nos. 1 and 2 are the gotnis of the informant whereas petitioner no. 3 is daughter of petitioner no. 1. Along with other male co-accuseds, they are facing accusations punishable under Sections 379, 354, 447 and other allied sections of the Indian Penal Code.

The allegation is that owing to a family dispute on partition of land, a scuffle had taken place in the common passage of both parties. The allegation of committing theft and forcible entering into the house is attributed against the petitioners. Considering the inter se relation of the parties, the place of occurrence as well as the allegations, I am inclined to extend the

Patna High Court Cr.Misc. No.25904 of 2016 (2) dt.04-07-2016 2/2 privilege of anticipatory bail to these petitioners. In the event of arrest or surrender in the Court below within four weeks, the petitioners abovenamed are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st, Sheikhpura in Jairampur P.S. Case No. 59 of 2015 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with further condition that one of the bailers shall be the own/close family members of the petitioners.
