2. In the present case, the petitioner seeks bail in connection with Biraul P.S. Case No. 474 of 2024 registered for the offences under Sections 420, 467 and 468/34 of the Indian Penal Code.

3. As per prosecution case, petitioner purchased and got registered the Government land from co-accused though the entry showed it to be in the name of 'Anabad Sarvsadharan'.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner purchased this land in the year 1999 and the FIR has been lodged in the year 2024 i.e., after more than 25 years. Petitioner has filed title suit claiming

The person from whom, the petitioner purchased this land, has been granted anticipatory bail by the learned trial court. Learned counsel reiterates that it is a civil dispute and petitioner is 74 years old. Petitioner is in custody since 27.06.2025 and is having clean antecedent.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of allegation coupled with age of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Biraul, Darbhanga/concerned court in connection with Biraul P.S. Case No. 474 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
