Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 379 of the Penal Code in connection with a mobile set referred to in the written report dated 25.02.2014, which is part of the First Information Report.
Let petitioner surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and explain to the Magistrate that he has been falsely implicated in the case as he has nothing to do with the mobile referred to in the written report and the Investigating Officer of the case has unnecessarily asked him to appear. Learned Magistrate should not only call for the case diary
Patna High Court Cr.Misc. No.43079 of 2015 (2) dt.16-10-2015 2/2 but also ask the Investigating Officer to appear and explain as to why does he require appearance of the petitioner in this case. In case, learned Magistrate is satisfied that no tangible material is levelled against the petitioner in the case, he be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Ist Class, Ara, Bhojpur in connection with Ara Rail P.S. Case No.12/14, subject to the conditions laid down under Section 438(2) Cr.P.C. otherwise pass order in accordance with law. Until such verification no coercive steps be taken against the petitioner.
The petition is, accordingly, disposed of.
