The petitioner apprehends arrest in Kuchaikote P.S. Case No. 290 of 2017 instituted for the offence under Sections 147,148,149,323,324,307,379,504,506 of the IPC. It is alleged in the written report that while the informant was sitting at his door, this petitioner along with other accused persons armed with lathi, danda pistol and iron rod came at the house of the informant and started abusing the informant. It is alleged that this petitioner assaulted the grandson of the informant Ankit Pandey with sword on the head causing injury and he fell down. Injury report of the injured Ankit Pandey, has been enclosed as Annexure-3 to this petition, wherein, doctor has found cut injury 4cm x 1/4cm, scalp deep

Patna High Court Cr.Misc. No.15248 of 2018(2) dt.12-04-2018 2/2 on right side middle of head red colour bleeding present and one abrasion on right side chest 3 cm x 1 1⁄2 cm. Doctor has opined that the injury no. 1 has been caused by sharp cutting weapon and injury no. 2 caused by hard and blunt substance. Both injuries are simple in nature.

From written report, it appears that there is specific allegation against the petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
