JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the informant is apprehending arrest in a case initially registered for the offences punishable under Sections 498A, 307, 324 and 326A/34 of the Indian Penal Code subsequently Section 304B IPC was also added.

The prosecution case is of inflicting torture for nonfulfillment of the dowry demand and ultimately setting the informant on fire after pouring kerosene oil. It is submitted by the learned counsel for the petitioner that the victim died after one month of the occurrence. The accusation is general and omnibus against the entire in-laws family including the petitioner and thrust of accusation is against

Patna High Court Cr.Misc. No.31976 of 2016 (3) dt.23-08-2016 2/2 the husband of the victim. The victim received accidental burn injury.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Saharsa (Mahila) P.S. Case No. 31 of 2016 pending in the court of learned JM, 1st Class, Saharsa. Accordingly, the application is disposed of.
