JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-11-2022 Heard learned counsel for the petitioner and Ms. Babita Kumari, learned AC to SC-1 for the State. This writ application has been filed seeking direction to the respondents to conduct proper investigation of Nath Nagar Police Station Case no. 269 of 2022 registered under Sections 341, 147, 148, 149, 323, 427, 386, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that now the case has already been investigated and chargesheet has been

Patna High Court CR. WJC No.1176 of 2022(2) dt.21-11-2022 2/3 filed, therefore, this aspect of the matter has lost its significance. The submission of learned counsel for the petitioner is that the petitioner has threat to his life and property and he needs security to protect it.

In this regard, he has submitted a representation to the District Magistrate, Bhagalpur as well as to the D.I.G., Bhagalpur. A copy of the same is Annexure '2 series' to the writ application.

Learned AC to SC-1 for the State submits that in such circumstance, the competent authority may be directed to take an appropriate view of the matter and consequential action thereof.

Having regard to the facts and circumstances and the materials placed before this Court, this Court directs the District Magistrate as well as Senior Superintendent of Police, Bhagalpur to look into the request of the petitioner for providing him security, assess his threat perceptions and in case, it is found that the petitioner has got threat to his life and property, appropriate recommendations shall be made to the competent committee for considering his case for providing security.

Learned counsel for the petitioner submits that in fact

Let a decision be taken within a period of three months from the date of communication of this order. The application stands disposed of accordingly.
