Petitioner being the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The prosecution case is of killing the daughter of the informant after 15-16 years of marriage by administering poison. Eight years old son of the victim has also suggested the name of the petitioner, who has administered poison to the victim.

It is submitted by the learned counsel for the petitioner that the informant has retracted from the initial version and filed a petition to that effect before learned court below.

Keeping in view that the other accused persons

Patna High Court Cr.Misc. No.42831 of 2015 (2) dt.14-10-2015 have been granted bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bahera P.S. Case No. 255 of 2014, pending in the court of learned Additional Chief Judicial Magistrate, Biroul at Benipur (Darbhanga). With the above observation this application is disposed of.
