Learned counsel for the petitioner submits that the matter relates to Sampoorna Gramin Rojgar Yojana (S.G.R.Y.), under that scheme, the petitioner was given food grains but, he could not show the entire utilization of the food grains, on that account, for recovery of Rs. 42,478.30/-, a proceeding under the P.D.R. Act has been initiated against the petitioner and, for that, a notice has also been issued to him.

Learned counsel for the petitioner submits that the petitioner is ready to pay the entire certificate amount. If that be so, the petitioner would file an application

Patna High Court CWJC No.6315 of 2017 dt.29-06-2017 before the Certificate Officer, Sasaram and if the petitioner would deposit the entire amount of recovery, in such circumstances, there will be no purpose for continuation of the certificate proceeding against him.

Let the petitioner should file an application before the Certificate Officer, Sasaram who will pass an order in accordance with law.

The Certificate Officer, Sasaram, while considering the issue of payment of money, will also take into consideration the order passed by this Court.

With the aforementioned observation, this application is disposed of.
