2. The petitioner seeks regular bail in connection with Gaighat P.S. Case No. 200 of 2023, registered for the offence punishable under Sections 341, 323, 307, 354, 366, 376, 420, 120(B), 504, 34 of the Indian Penal Code.

3. As per prosecution, the petitioner and the informant developed friendship and they had consensual sex for which petitioner is said to have in jail.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 01.06.2023.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.54522 of 2023(2) dt.25-08-2023 2/2 for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur in connection with Gaighat P.S. Case No. 200/2023.
